Terms and Conditions

These Terms and Conditions ("Terms") govern access to the website aiballoondecorations.in ("Website") and the provision of balloon decoration and event-decoration services by AI balloon decorations, a proprietorship of Vikas Vikram Punia having its business address at 277, Navi Mumbai, Mumbai, Maharashtra – 400703 ("AIM", "we", "us", "our").

By placing a booking, making a payment, or otherwise availing AIM's services, the customer ("Customer", "you") agrees to be bound by these Terms. If you do not agree, please do not proceed with a booking.

1. Services: AIM provides balloon and event-decoration services in accordance with the packages, designs, and prices displayed on the Website or otherwise confirmed in writing. The precise scope of any booking shall be as set out in the booking confirmation issued by AIM, which shall prevail over general Website descriptions in case of conflict.
2. Eligibility: The Customer must be at least 18 years of age and legally competent to contract. Where a booking relates to an event involving a minor, the booking shall be placed and the contract entered into by the minor's parent or lawful guardian. By booking, the Customer warrants that the information provided is true, accurate, and complete.
3. Representative Nature of Website Content: Photographs and descriptions on the Website are illustrative. Actual execution may reasonably vary due to material availability, venue conditions, lighting, or necessary substitutions of comparable quality. Where a specific design element is material to the Customer, written confirmation must be obtained from AIM prior to payment.
4. Booking and Contract Formation: A booking becomes binding only upon written or electronic confirmation by AIM, subject to availability, receipt of the requisite payment, and acceptance of these Terms. AIM may decline a booking on grounds including unavailability, materially incomplete information, or suspected fraud, in which case any amount received shall be refunded in accordance with the Cancellation and Refund Policy.
5. Pricing and Taxes: Prices are as displayed or specifically quoted at the time of booking and are inclusive of applicable GST unless stated otherwise. AIM may revise prices prospectively; a confirmed booking shall not be affected by a subsequent price revision, save for Customer-requested alterations. The Customer is responsible for the accuracy of billing and GST details furnished for invoicing.
6. Payment: Payment shall be made through the modes made available by AIM, including Razorpay, PayPal, PhonePe, card, or cash. Unless otherwise agreed in writing, the applicable advance or full payment must be received before a booking is treated as confirmed. Payment gateway transactions are subject to the terms of the relevant payment provider; AIM shall not be liable for delays attributable solely to such third parties.
7. Cancellation, Rescheduling and Refunds: Cancellation, rescheduling, and refunds shall be governed by AIM's Cancellation and Refund Policy, having regard to the advance procurement, customisation, and personnel allocation inherent in decoration services. A cancellation or rescheduling request shall take effect only upon communication through an authorised channel (WhatsApp, email, or phone) and written acknowledgement by AIM.
8. Venue, Access and Permissions: The Customer is solely responsible for obtaining all permissions required for installation at the chosen venue, including any restrictions on drilling, adhesives, electrical fittings, helium, or installation timings, and shall disclose such restrictions to AIM in advance. AIM shall exercise reasonable care but shall not be liable for loss or damage arising from pre-existing defects, undisclosed venue restrictions, or Customer-supplied materials. AIM personnel may decline or modify an installation reasonably necessary to protect safety.
9. Customer Conduct: The Customer shall ensure lawful and reasonable conduct towards AIM's personnel. AIM may suspend performance where continued performance would endanger its personnel or property, without prejudice to the Customer's right to raise a genuine grievance under Clause 15.
10. Intellectual Property: All content on the Website, including designs, photographs, logos, and branding, is owned by or licensed to AIM and may not be reproduced or commercially exploited without prior written consent, save as permitted by law. Content lawfully supplied by the Customer remains the Customer's property, subject to any permission granted to AIM for promotional use as described in the Privacy Policy.
11. Photographs and Promotional Use: Use of any photograph or video arising from a booking, including any depicting a minor, for AIM's portfolio, Website, or marketing shall be governed by, and is subject to the consent requirements set out in, AIM's Privacy Policy.
12. Personal Data: Personal data furnished by the Customer shall be processed strictly in accordance with AIM's Privacy Policy, published on the Website, which is incorporated by reference into these Terms and forms an integral part of the contract between the Parties.
13. Force Majeure: AIM shall not be liable for any failure or delay in performance arising from circumstances beyond its reasonable control, including natural calamity, government restriction, strike, civil disturbance, or failure of essential utilities. AIM shall take reasonable steps to mitigate the effect of such circumstances and, where practicable, offer rescheduling or an alternative resolution.
14. Limitation of Liability: AIM's liability, where established, shall be limited to the amount paid by the Customer for the affected service and the direct loss actually proved. Nothing in these Terms excludes or restricts: (a) liability that cannot lawfully be excluded; (b) the Customer's statutory rights under the Consumer Protection Act, 2019; or (c) liability arising from fraud or wilful misconduct.
15. Grievance Redressal: Complaints regarding a booking or service shall first be addressed to AIM's Grievance Officer:

    AIM shall acknowledge a complaint within 48 (forty-eight) hours and endeavour to resolve it within 30 (thirty) days. Nothing herein restricts the Customer's right to approach the appropriate Consumer Commission or, in respect of personal-data grievances, the Data Protection Board of India, as provided under the Privacy Policy.
16. Amendment: AIM may amend these Terms and the Website's service offerings from time to time. The revised Terms shall take effect from the date of publication on the Website and shall not retrospectively affect a booking already confirmed, save as required by law.
17. Severability: Should any provision of these Terms be held invalid or unenforceable by a competent court or authority, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to give effect to its intent.
18. Entire Agreement: These Terms, read with the Privacy Policy, Cancellation and Refund Policy, and the applicable booking confirmation, constitute the entire agreement between the Parties in relation to the subject matter hereof, superseding all prior understandings, whether written or oral.
19. Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India. Subject to any mandatory jurisdiction conferred by the Consumer Protection Act, 2019 or other applicable law, the courts at Navi Mumbai, Maharashtra alone shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the services provided by AIM.
20. Notices: All notices, complaints, and communications to AIM shall be addressed to the contact details below. AIM shall be entitled to communicate with the Customer at the email, phone, or WhatsApp number furnished at the time of booking.
